This is an excellent thesis, Rachel. I came across it by accident while googling "Libya Layden". Many of the men you mention are my friends. Sadly Libyan Faraj Hassan (AS) died in a motobike accident in August 2010 a few months after getting his life back. Now we have all these secret documents coming out of Libya which proves the collusion of the UK government on the mistreatment of Libyans who were rendered to Libya.
I still remain hopeful that my Algerian and Jordanian friends will be vidicated too. Meantime they live half lives with their wives and families on the restrictive immigration bail. Some of these Algerians have suffered since the end of 2001 and there seems to be no light at the end of the tunnel. I wonder if you have ever attended a SIAC hearing?
Anyway, Rachel, I will save your article for reference. You deserve praise for all your hard work in putting it all together. Thanks.

It never ceases to amaze me the amount of people who make comments on Scottish Justice and only see it from one side. We all know how justice should be administered but when it is not done correctly someone pays the consequences. This someone then has an impossible tasks to try and rectify the errors more often that not from inside prison walls and with NO help what so ever.
Yet still the so called legal eagles carry on extolling the virtues of Scottish Justice. The Government is not the slightest bit interested in justice and does all it can to sweep under the carpet malladministration and criminal acts of our prosecuters and police. Things will never change as the will is simply not there.

How can leagal advisers to the Government advise when they do not speak with the right people, those who have suffered at the hands of our corrupt justice system?

One example....Crown office conceals evidence from the defence, eye witness evidence because it would ruin their case and prove the accused innocent. The police conceal eye witnesses from the defence even after being instructed by the Crown to assist the defence in locating said witnesses. Police officers and the Crown deny the very existance of said witnesses yet the Crown go on to call one as a witness......They still deny the existence of the witness and refuse to accept his testimony.

Statements given by the witnesses are recorded in police officers note books including the officer instructed to assist the defence locate the self same witnesses.

Police officer reads a statement from his note book which he swears the accused made. The accused denies this. It is much later established the there is no statement in the officers note book from the accused.

So what can the now guilty man do? Serve his time in prison ( 14 years) or fight? Fight with what? Do not ask lawyers or advoicates to help as there is no money in it and they know full well its a lost cause.

Write to the Justice minister who refuses to reply but sends the letter containing irrefutable evidence of corruption at the Crown office and with in the police.....to the Crown Office. They in turn have the accused police officers investigate themselves whilst the Crown investigate themselves. No prizes for the outcome of either investigation.

So where does the wrongly convicted man go next? No where as all doors are closed in his face in order to protect the justice system.

If the government and advocates who advise them were really interested in a better justice system they should start by cleaning up the one we currently have before moving on to bring in much needed changes.

Will this happen? Of course not as the cattle market that is the accused persons must be kept going to feed the ego's and pay the bills of our legal system and not forgetting the prison system.

Justice in Scotland, dont make me laugh.

[...] The Council of Europe’s European Court of Human Rights ruled in 2009 that boycotts were illegal. Specifically of Israeli goods. So I believe that WDC are acting illegally and any other council in the UK or Europe that is so minded are also breaking the law. [...]
