On Public Law – Judicial Deference – when and to what degree should judges defer to Parliament and the Executive?

Ampersand Stable Key Lecture Series:

Aidan O’Neill QC with look at deference to Parliament (Scottish and UK) in relation to challenges to primary legislation.

Jane Munro will then look at deference to the Executive (Scottish and UK) when it is exercising its function of making secondary legislation.

Professor Adam Tomkins will then focus on the situation of decisions involving national security and the welfare of the nation in the face of the terrorist threat.

This seminar will contribute to 1 ½ hours of CPD.
