R (Brooke) v SSHD

The Court was required to determine whether policies promoted by the defendant Secretary of State unlawfully resulted in the claimant prisoner not being released on home detention curfew. Application refused. The Court found that art 14 of the ECHR was not breached as the position of UK nationals regarding their release on home detention curfew and those foreign nationals who were released early from prison and removed from the UK was not analogous. Sam Grodzinski was involved in this case.
