The Lord Ordinary held that in the context of assets recovery proceedings under the Proceeds of Crime Act 2002 to recover the proceeds of crime it could not be argued that the limitation period of 12 years under the Prescription and Limitation Scotland Act 1973 s. 19B  contravened the right to a hearing within a reasonable time, at least in the absence of any authority in the European Court of Human Rights.
