Dove v. Scottish Ministers

The Article 2 Protocol 1 right to an education in conformity with parents’ own religious and philosophical convictions was unsuccessfully relied upon in the context of a judicial review challenge to the decision of the Scottish Ministers to end the self-governing status of St. Mary’s Episcopal school in Dunblane.  The Extra Division acknowledged held that while the Convention guaranteed the right for fee paying independent schools to be permitted within Contracting States, Article 2 Protocol 1 did not entail the right to obtain from public authorities State funding for any particular school with a distinctive religious or philosophical underpinning.
