January 31, 2009 | No CommentsThe European Court of Human Rights (ECtHR) emphasised that Article 7 not only prohibits the retropsective application of criminal law but also protects the principal that only the law can “define a crime and prescribe a penalty”. A crime must therefore be clearly defined in the law and an individual must be able to tell from the wording of the provision what acts and ommisisons will make him criminally liable.
