R v Highland Council

An individual who had been placed as a child in foster care by order of the local authority raised an action of damages against them on reaching majority claiming after the Council removed her from the care of her mother and stepfather in 1997, they failed to facilitate her continuing to follow her religious persuasion of Catholicism by placing her with two sets of Protestant foster carers, failed to properly assess her various needs and carry out a paediatric occupational therapy assessment, failed to ensure she maintained direct contact with her natural mother and prevented her from having and maintaining a family life in breach of her rights under Article 8.
